Public Offer (Proposal)
General Provisions
This agreement is the official and public offer of LLC Colard regarding the sale of goods presented on the website www.colard.ge. This agreement is public according to Article 329 of the Civil Code of Georgia. Its terms are identical for all buyers without granting preference to any individual. By concluding this agreement, the buyer fully agrees with the terms of order placement, payment, delivery, return of goods, liability for improper orders, and other terms of this agreement.
Definitions of Terms

Public Offer (hereinafter “Offer”) – A public proposal from the Seller to an undefined number of persons to conclude a distance sales agreement (hereinafter “Agreement”) for the sale of goods under the conditions described herein.

Goods – The subject of agreement between the parties, selected by the buyer on the online store’s website and placed in the cart, or already purchased remotely from the seller (adjustable and non-adjustable supports, their accessories, components, and related items).

Online Store – The seller's website at www.colard.ge, created for wholesale and retail sales agreements based on the buyer’s review of the descriptions of the offered goods via the internet.

Buyer – A legally capable individual of at least 18 years of age who has entered into this agreement under the terms listed below.

Order – The buyer’s selection of specific goods from the list, placing them into the cart, and completing the payment.

Cart – A virtual space on the seller’s website where the buyer’s selected products and prices are displayed.

Delivery – The supply of goods to the buyer’s address via an independent shipping service (delivery service) within Tbilisi.

Seller – LLC Colard, company ID: 405090501.

Subject of the Agreement
The seller undertakes the obligation to transfer the goods to the buyer, who in turn undertakes to pay for and accept the goods under the terms of this agreement.
The moment of full and unconditional acceptance of the offer and conclusion of the electronic sale agreement is considered to be the moment when the buyer pays for the order according to the terms and conditions specified on the seller's website.
Order Placement

The buyer registers on the site, opens an account, and independently places an order through the "cart" function of the online store.

The buyer has the right to order any product available and presented on the website.

Each product may be ordered in any quantity.

If a product is out of stock, the online store manager must notify the buyer (by phone or email).

If the product is unavailable, the buyer may choose a similar product, cancel the product, or cancel the entire order.

If payment is not received on the seller’s account, the seller reserves the right to cancel the order.

The seller has the right to refuse order fulfillment if the information provided by the buyer during order placement is incomplete or its authenticity is questionable.
Upon registration and order placement, the buyer agrees to provide the following necessary information for order fulfillment:

Delivery address (if applicable)

Contact phone number

Details of the selected product (name, quantity, type, and price), to be specified in the cart on the website.
If either party requires additional information, they have the right to request it. If the buyer fails to provide the necessary information, the seller is not responsible for the quality of service.
The buyer is responsible for the accuracy of the information provided when placing the order.
By agreeing to this offer and placing an order, the buyer confirms the following:
a) They have read and agree with the terms of this offer in full;
b) They consent to the collection, processing, and transfer of personal data. This consent remains valid throughout the term of the agreement. The buyer confirms that they are informed (without additional notice) of their rights under the Georgian Law on Personal Data Protection, the purposes of data collection, and that the data will be transferred to the seller for agreement execution, mutual settlements, and receipt of invoices, acts, and other documents. The buyer also agrees that the seller may grant access and transfer the buyer’s data to third parties without additional notification, to fulfill the order.
Price and Delivery

Prices for goods and services are determined independently by the seller and listed on the website in Georgian lari (GEL), including VAT.

Prices may be changed unilaterally by the seller based on market conditions. However, prices for goods already fully paid by the buyer cannot be changed.

Placing items in the cart does not guarantee that their prices will remain unchanged.

The price shown on the website does not include delivery to the buyer’s address.

Delivery services and charges are specified separately on www.colard.ge.

The buyer’s obligation to pay is fulfilled when the funds are received in the seller’s account.

Settlements between the buyer and seller are made using the payment methods specified on the website’s "payment" section.
Upon delivery, the buyer must verify the goods in the presence of the delivery service representative (name, quantity, completeness, expiration date). If these conditions are not met, the goods are considered accepted with appropriate quality and completeness and are not subject to return. If a defect or mismatch is found and documented before the courier leaves, the goods can be returned immediately.
Upon acceptance, the buyer or their representative signs the sales receipt/order/shipping waybill, confirming no claims about quantity, appearance, or integrity. At this point, ownership and risk of accidental loss or damage transfer to the buyer or their representative.
Until delivery, the risk of damage or loss lies with the seller.
Rights and Obligations of the Parties
The Seller is obliged to:

Provide detailed product information in accordance with Article 6 of the Georgian Law on Consumer Protection.

Deliver goods to the buyer within Tbilisi in accordance with the order and the terms of this agreement.

Not disclose personal information about the buyer to third parties except as required by law or this agreement.
The Seller has the right to:

Unilaterally amend the terms of this agreement, as well as prices, by publishing them on the website. All changes take effect immediately upon publication.

Unconditionally and without notice, suspend or cancel the buyer's account if they violate this agreement.
The Buyer is obliged to:

Review the agreement terms and prices before concluding the agreement and placing an order.

Provide accurate data necessary for identification and order delivery.
-
If the buyer disagrees with any amendments per Article 36, they must close their account.

By placing an order, the buyer confirms acceptance of all agreement terms.
Return of Goods

The buyer has the right to return goods within 14 (fourteen) calendar days (excluding the purchase date) if the wrong item was delivered, the product is expired, or damaged, and these issues were not detected during delivery due to valid reasons, or the courier refused to return the product.
In such a case, the buyer must photograph the defective product and send the complaint with photos to the seller’s email: info@colard.ge.

If the claim is accepted, the buyer must return the goods at their own expense. The seller will replace the item or refund if a replacement is unavailable.

Claims are reviewed within 30 business days.

Returns are accepted only if:

The product has not been used,
-
Consumer properties, appearance, packaging, seals, and labels are preserved,

The buyer has proof of payment.

Refunds are made within 30 calendar days from the date of claim review.
-
Refunds are issued by bank transfer to the buyer’s account.

Returns are made to the seller’s address at the buyer’s expense unless otherwise stated.
The seller fulfills obligations under the Law on Consumer Protection upon submission of required documents. The seller is not responsible for defects arising after delivery, due to improper use or storage, third-party actions, or force majeure.
Returns must be sent to the address listed under the “Contacts” section of the website.
Liability

The seller is not liable for damages to the buyer or third parties resulting from improper use or storage of goods.

The seller is not liable for failure to fulfill obligations due to inaccurate or false information provided by the buyer.

The seller is not liable for service delays (order processing and delivery) caused by technical reasons beyond its control.

Both parties are responsible for fulfilling their obligations under Georgian law and this agreement.

Either party is released from liability for full or partial non-performance due to force majeure (war, natural disasters, etc.) beyond their control, occurring after the agreement was made. The affected party must notify the other party immediately.
Confidentiality and Personal Data Protection
By registering or placing an order, the buyer voluntarily consents to the processing, use (including transfer), and any other lawful handling of their personal data in accordance with the Georgian Law on Personal Data Protection, with no time limit...
